un debate si acreditar o no a la CONEAU? Sobre su
inconstitucionalidad…<o:p></o:p></u></strong></p>

class="MsoNormal">La respuesta es muy concreta:<strong> porque los
artículos de la ley que la definen están declarados
inconstitucionales… </strong>veamos:<o:p></o:p></p>
<p style="margin-bottom: 10pt; text-align: justify; line-height: 115%;"
class="MsoNormal">Si uno lee la Ley de Educación Superior (<a
href="http://www.coneau.edu.ar/archivos/447.pdf">http://www.coneau.edu.ar/archivos/447.pdf</a>),
encuentra que es taxativa: todas las carreras de interés
público están obligadas a acreditar a la CONEAU, no hay otra
posibilidad. Sin embargo, en el debate sobre la CONEAU, el hecho de
acreditar o no aparece como opcional, ¿por qué ocurre esto?
<o:p></o:p></p>
<p style="margin-bottom: 10pt; text-align: justify; line-height: 115%;"
class="MsoNormal">En el año 1996, la UBA recurrió a la
justicia, presentó un amparo y consiguió un dictamen
favorable: el fallo del Juez Marinelli (<a
href="http://www.megaupload.com/?d=NYSXENV0">http://www.megaupload.com/?d=NYSXENV0</a>)
declara inconstitucionales los artículos 29, 42, 43, 46 y 50 de la
Ley de Educación Superior (a pesar de que el decano de esta
facultad haya dicho que sólo era el 50 y que eso era algo menor en
una sesión del CD de diciembre de 2009) por considerar que violan
la autonomía universitaria y que se encuentran en el marco de una
ley que abren las puertas al arancelamiento de la Universidad
pública. Al respecto, recomendamos un artículo de la revista

hasta el día de hoy.<o:p></o:p></p>
<p style="" class="MsoNormal">Los artículos 42, 43 y 46 son
justamente los artículos fundamentales referidos a la
acreditación de carreras. Nos llama profundamente la
atención que en esta facultad tan atenta a las cuestiones legales
(a veces por sobre las éticas: se aceptaron los fondos manchados de
sangre de la mega-minería y se dijo que era porque estaba escrito
en una ley) se quiera acreditar a la CONEAU si está declarada
inconstitucional.<o:p></o:p></p>

parecen importantes, esperando que produzcan nuevas preguntas y nuevas

class="MsoNormal">Este cuatrimestre habrá unas jornadas de debate
seguidas de un plebiscito preguntándonos sobre la CONEAU. Creemos
que el debate sobre la CONEAU es importante porque nos remite a
plantearnos <strong>qué tipo de universidad queremos, quién
la financia, quién estudia en ella y quién no, a
quién sirve nuestra educación y trabajo.</strong> Por eso es
tan complejo. Desde nuestro punto de vista, es entonces un debate que nos
incluye e incumbe a todos. Proponemos tomar una postura activa en este
debate: informarse, reflexionar, discutir, actuar, organizarse. Cuantos
más seamos, cuanto menos deleguemos nuestra voz en unos en manos de
unos pocos, más cerca estaremos de construir una universidad para
todos.<o:p></o:p></p>
